TERMS OF SERVICE

These Terms of Service govern the use of the Croesthetic website and the purchase of products through our online store.

By using our website or placing an order, you agree to these Terms. If you do not agree with them, please do not use the website or place an order.

2. Eligibility

You must be legally capable of entering into a binding contract under the laws applicable to you in order to place an order.

If you are under the applicable age of legal capacity, an order must be placed with the involvement or consent of your parent or legal representative where required by law.

3. Products

We make reasonable efforts to ensure that product descriptions, images, specifications and other information displayed on our website are accurate.

Product colours and appearance may vary slightly depending on your device or display.

We reserve the right to correct obvious errors in product descriptions, prices or availability.

Nothing in these Terms affects mandatory consumer rights relating to product conformity, defects or safety.

4. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not guarantee that the product will remain available until checkout.

If a product becomes unavailable after an order has been placed, we will inform you and, where applicable, refund any payment made for the unavailable product.

5. Prices

All prices displayed on the website are stated in [HUF/EUR].

Where VAT is legally applicable, prices displayed to consumers will include the applicable VAT unless clearly stated otherwise.

Any applicable delivery fees or additional charges will be displayed before the customer completes the order.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted, except where an obvious pricing error has occurred.

6. Ordering

To place an order, you must:

  1. select the desired products;
  2. add them to your shopping cart;
  3. provide the requested information;
  4. select a delivery method;
  5. select a payment method;
  6. review the order details and total price; and
  7. submit the order.

Before submitting an order, you will have the opportunity to review and correct your order details.

By submitting an order, you acknowledge that the order involves an obligation to pay.

7. Order Confirmation

After submitting an order, you will receive an electronic confirmation at the email address provided during checkout.

The confirmation acknowledges receipt of your order.

A contract between you and the seller is concluded in accordance with applicable law and these Terms when your order has been accepted.

If we are unable to fulfil your order, we will notify you and refund any payment already made for the affected order.

8. Payment

We accept the payment methods displayed during checkout.

Payments may be processed by third-party payment providers.

We do not directly receive or store complete payment-card information where payment processing is handled by a third-party payment provider.

The payment provider’s own terms and privacy policies may also apply to the processing of your payment.

9. Delivery

We deliver to the locations displayed and supported during checkout.

Available delivery methods, estimated delivery times and delivery costs will be displayed before you complete your order.

Delivery times are estimates unless a specific delivery date or period has been expressly agreed.

If no other delivery period has been agreed, applicable EU consumer law generally requires delivery within 30 days.

Once the order has been handed to the carrier, delivery may also be affected by circumstances outside our reasonable control.

10. Risk During Delivery

For consumer purchases, the risk of loss or damage to the goods generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically receives the goods.

Where the consumer independently chooses a carrier that was not offered by us, risk may pass in accordance with applicable law.

Nothing in these Terms limits mandatory consumer protections.

11. Right of Withdrawal

If you are a consumer purchasing goods online, you generally have the right to withdraw from the contract within 14 days without providing a reason.

For goods, the withdrawal period generally begins when you or a third party designated by you receives the goods.

To exercise your right of withdrawal, you must notify us of your decision by an unequivocal statement before the withdrawal period expires.

Where required, we will also provide an applicable withdrawal form or online withdrawal procedure.

12. Exceptions to Withdrawal

The statutory right of withdrawal does not apply in circumstances where an applicable legal exception exists.

Depending on the products we sell, this may include, for example:

  • goods made according to the consumer’s specifications or clearly personalised;
  • sealed goods that are unsuitable for return for health or hygiene reasons once the seal has been removed;
  • goods that are liable to deteriorate or expire rapidly; and
  • other categories excluded by applicable law.

Any applicable exception will be communicated to the customer before purchase where legally required.

13. Returns and Refunds

If you validly exercise your right of withdrawal, you must return the goods in accordance with our Returns & Withdrawal Policy.

Unless otherwise required by law, you are responsible for the direct cost of returning goods following withdrawal.

We will refund eligible payments in accordance with applicable law.

Unless otherwise required by law, we may withhold the refund until we have received the returned goods or you have provided evidence that the goods have been sent back, whichever occurs first.

Refunds will generally be made using the same payment method used for the original transaction unless another method has been agreed.

14. Condition of Returned Goods

You may handle the goods only to the extent necessary to establish their nature, characteristics and functioning.

You may be responsible for a reduction in the value of goods caused by handling beyond what is necessary for this purpose, to the extent permitted by applicable law.

This does not affect your statutory withdrawal rights.

15. Faulty or Non-Conforming Products

If a product is defective, damaged, or does not conform to the contract, you may have statutory rights under applicable Hungarian and EU consumer law.

Depending on the circumstances, these rights may include repair, replacement, a price reduction or termination of the contract and a refund.

These statutory rights apply independently of any voluntary return or commercial policy offered by us.

16. Legal Guarantee and Warranty Rights

Consumers may benefit from mandatory statutory guarantee, warranty and conformity rights under Hungarian and EU law.

Where mandatory statutory rights apply, nothing in these Terms limits or excludes those rights.

Additional mandatory Hungarian rules concerning kellékszavatosság, termékszavatosság and jótállás may apply depending on the product and circumstances.

18. Consumer Dispute Resolution

If we cannot resolve a consumer complaint directly, consumers may have access to alternative dispute-resolution mechanisms available under Hungarian law, including the competent conciliation board (békéltető testület) where applicable.

The competent authority or conciliation board may depend on the circumstances of the dispute and the consumer’s location.

Mandatory consumer rights concerning dispute resolution remain unaffected.

If the website allows customers to create an account, you are responsible for keeping your account credentials confidential.

You must provide accurate information and notify us if you believe your account has been accessed without authorisation.

We may suspend or terminate an account where reasonably necessary to protect the website, other customers or our legitimate interests, subject to applicable law.

The website may occasionally be unavailable due to maintenance, technical problems, security issues, hosting problems or circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing limits statutory consumer rights or liability that cannot legally be excluded or limited.

To the maximum extent permitted by law, we are not responsible for indirect losses that are not reasonably foreseeable at the time the contract was formed.

25. Force Majeure

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, government actions, major infrastructure failures, widespread technical failures, strikes or significant disruptions to transport or communication networks.

Where such circumstances affect an order, we will take reasonable steps to inform affected customers.

Personal data is processed in accordance with applicable data-protection legislation, including the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable Hungarian law.

The invalid provision will be replaced or interpreted in a manner that most closely achieves its intended lawful purpose.

30. Governing Law and Jurisdiction

These Terms are governed by the laws of Hungary, except where mandatory consumer-protection laws of another jurisdiction apply.

If you are a consumer residing in another EU Member State, nothing in these Terms removes or restricts mandatory protections granted to you under the applicable laws of your country of residence.

Any dispute will be handled by the competent courts or dispute-resolution bodies in accordance with applicable law.
